The Change of Venue motion filed by the defense in the Jason Carter murder trial will be heard today at the Marion County Courthouse.

In order to receive a change of venue, the defense must convince the court that a degree of prejudice exists in the county, which would make selecting a fair and impartial jury impossible. The State argues the publicity on the case has not been inflammatory or emotional enough to require a change in venue, rather it focuses on the unusual nature of the case, and that the State asserts the citizens of Marion County are fair-minded and capable of abiding by their oaths as jurors. The State also requests that if a change of venue is granted, finding a courthouse that is easily accessible and ease of travel should be considered. The hearing is scheduled for 2:30pm.
