The Marion County Sheriff’s Office and the DCI are resisting the release of a 911 call that Jason Carter made on the day his mother was murdered.
The plaintiff in the Carter v. Carter civil case, William Carter et. al., requested the call be admitted as part of the discovery for their wrongful death suit against Jason Carter. The Sheriff’s office and the DCI asked for the subpoena to be denied citing Iowa code that stipulates information not be released if it would adversely affect an ongoing investigation. Ron Danks, attorney for William Carter et. al., filed a brief resisting the motion to deny based on code that says materials can be released if they are important to a civil case and argues that it hasn’t been sufficiently shown that release of the 911 call would be contrary to the public interest or damaging to the murder investigation. The dispute will be decided at the Marion County Courthouse Friday.
