The family of a man who died after he passed out inside of Sully Truck Wash has filed a lawsuit.

Willie Mercer’s family filed against Sully Truck Wash and Brent Vander Molen in Jasper County, stemming from an incident with led to Mercer’s death on January 21st, 2014. Newton attorney Corey J. L. Walker, who represents the family, says that Willie’s death could have been prevented if Sully Truck Wash would have followed the OSHA requirements. According to a report from the Iowa Division of Labor, employees were not informed of the hazards of a permit space, not trained on permit required confined entry spaces, and appropriate personal protective equipment was not available for use by employees entering a permit space.The Iowa Division of Labor cited Sully Truck Wash with OSHA violations and imposed a fine of $8,400. Sully Truck Wash eventually agreed to pay a reduced fine of $5,000 for 4 citations.
