Kading Properties has filed a Writ of Certiorari against the City of Indianola regarding the recent decision on the Kading Properties proposal to build 150 rental homes on two separate lots at 1500 N 9th St. A Writ of Certiorari is a court process to seek judicial review of a decision of a lower court or administrative agency. According to the court filings, Kading Properties is asking for a review of the Indianola City Council’s decision to deny the buildings, stating that the site plans are in full compliance with the city’s zoning ordinances, city’s zoning map, the city’s comprehensive plan, and future land use map, and the denial of the plan says the city “has acted arbitrarily, capriciously, in bad faith, contrary to its own zoning ordinances; zoning map, comprehensive plan by refusing the site plans.” Kading Properties has also submitted a revised application to the City for the proposed Lincoln Ridge developments, and city staff has recently commenced the review process of the revised application which includes code compliance, review by the planning and zoning commission, and review and action by the Indianola City Council. Citing the ongoing litigation, the City of Indianola has no comment on the court filing at this time.
