A Knoxville man has been charged with first degree burglary and assault stemming from an incident that occurred late Monday night.

According to court records, at 10:31 pm Monday, Knoxville Police Officers were dispatched to a 911 call for two males fighting at a home on Dolores St. A victim informed dispatch that he was punched by the defendant, Joseph Utterback. Upon arrival, the defendant advised officers that they should call Knoxville Rescue because he seriously injured that individual.

Officers made contact with the victim, where they observed bloody and swollen lips. The victim told officers he was sleeping when he heard the defendant enter his house through the walk-in garage door, and that he did not know the defendant was coming over and did not permit him to enter his residence. The victim got out of bed and locked himself in another room to hide from the defendant. The defendant allegedly broke down the door and is accused of punching the person inside in the face.

Utterback is charged with first degree burglary which is a Class B felony, and assault while participating in a felony, which is a Class D felony. Utterback is being held in the Marion County Jail on a $20,000 bond and is due in court for a preliminary hearing on May 30th.
